Terms & Conditions for CUSTOMERS
Please read the terms and conditions listed below in their entirety. By using our site you are bound by all of the terms and conditions. AE DESIGN reserves the right to change and amend these terms at any time. If you do not agree to these terms do not use or access this site.
1. It is strictly prohibited to republish, copy, or redistribute any content or software contained in this site.
2. Customer Content – You agree not to provide AE DESIGN with any artwork, designs, photographs, text or information or any other content that you do not have the right to reproduce. You further agree that in the event you do provide us with unlicensed or copyrighted material to reproduce you are responsible in whole for all penalties, legal expenses and fines relating to AE DESIGN's reproduction of such materials.
3. Printing Prices are based on the CUSTOMER supplying all artwork and setting up files as outlined by AE DESIGN. If CUSTOMER requires AE DESIGN to design, setup or check files CUSTOMER will be billed at AE DESIGN's then current rate at the time of order. NO EXCEPTIONS – NO EXCEPTIONS – NO EXCEPTIONS.
4. PAYMENT: 100% payment is Due at Order. All reorders must be paid in full prior to any printing and production. AE DESIGN will not do any work on orders until payment has been made in full.
5. ORDER APPROVAL:Orders are considered approved by CUSTOMER once payment has been received by AE DESIGN.
6. PROOFS: AE DESIGN will send a soft proof (digital proof). NO HARD PROOFS will ever be supplied. Please note: soft proofs and proofs that you print on your printer will not accurately show how the colors will look when we print. Proofs should be used to check text information and layout only.
7. REFUSAL: CUSTOMER understands and acknowledges that AE DESIGN reserves the right to refuse, at any time, to print or mail any copy, photographs or illustrations of any kind that in its sole judgment, it believes, is an invasion of privacy, is degrading, libelous, unlawful, profane, obscene or pornographic; or tends to ridicule or embarrass, or is in bad taste, or which in its sole judgment is an infringement on a trademark, trade name, or copyright, belonging to others.
8. AE DESIGN is not responsible for errors or omissions by the CUSTOMER including but not limited to: Misspelling, Damaged Fonts, Bleeds, Graphics, Wrong Cuts, Incorrect or Missing Folds.
9. ORDER CANCELLATION: There will be a cancellation fee (15%-30% of order amount) for all orders cancelled prior to production. Additional fees may be assessed depending on the stage of production.
10. ALL SALES ARE FINAL: If we verify that we made an error, we will re-print the order. No Refunds or Credit. Customer must notify AE DESIGN within 6 business days of order acceptance to notify any defects discovered in the ordered product. In order to receive replacement Customer must return 100% of the received product within 15 days (at their own expense) from the time when the ordered product delivery was taken. All charges related to expedite printing (Rush Printing or Shipping) are NOT REFUNDABLE, including for those orders that are returned for any reason.
11. AE DESIGN AND ITS EMPLOYEES, MEMBERS, DIRECTORS, AFFILIATES AND VENDORS SHALL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR LOST PROFITS ARISING OUT OF THEIR WORK OR SERVICES OR THE SUPPLY OF MATERIALS OR OTHERWISE ARISING OUT OF OR RELATING TO AN ORDER OR THE PERFORMANCE OR BREACH THEREOF, EVEN IF AE DESIGN OR ITS EMPLOYEES, MEMBERS, DIRECTORS, AFFILIATES AND VENDORS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. AE DESIGN Will not provide any design files designed by the customer through Quick Designer or Advanced Designer. All images provided through this site remain the property of their respective owners and under no circumstances shall rights be transferred beyond the ordering of print materials through this site.
13. CHOICE OF LAW: This Agreement shall be construed in accordance with the laws of the State of Texas.
14. TAXES: CUSTOMER is responsible for collecting and paying all Sales Tax.
15. AE DESIGN does not guarantee exact color matching.
16. AE DESIGN does not guarantee exact delivery dates.
17. DELIVERY – All prices are based on a single delivery per order. We do not split ship orders.
18. PRICES – All prices are subject to change without notice.
19. FORCE MAJEURE: If performance of AE DESIGN is delayed by reason of fire, war, civil disturbance, strike, damage by the elements, or other casualty, condemnation, governmental actions, interruptions of power or communication, transportation problems, or any other cause beyond AE DESIGN’s reasonable control, such non-performance shall not be default hereunder and the limit of performance shall be extended for the period which is reasonable in light of such delay.
20. AE DESIGN reserves the right to refuse service without disclosing a reason.
